Workers' Compensation

At Attorneys Inc., P.C., one area of law we emphasize is representing people with work related injuries. Over the years our lawyers have represented hundreds of Workers' Compensation claimants injured at work. Attorneys Inc.'s "work comp" practice generally concerns claims with Montana employers, both in Missoula and across the state. Sometimes the claim concerns an employer located in a different state. Montana Workers' Compensation law may apply to these claims as well.

This law office handles a wide variety of claims for on-the-job injuries. Some common types include back and shoulder strains, injuries caused by traumatic accidents, and overuse or repetitive motion injuries (such as carpal tunnel syndrome). Sometimes the pain and lost income of a work injury causes emotional trauma. This emotional trauma can require medical care and can interfere with a person's ability to return to work. The lawyers at Attorneys Inc. can help determine if you are entitled to compensation for this type of emotional trauma.... A work-related injury need not cause permanent injury to receive compensation. Temporary injuries that meet certain legal requirements are also compensable.

Workers' Compensation insurance is required through the employer, a private insurance company, or the Montana State Fund.

After being reported to the employer, Montana Workers' Compensation claims are filed with the Employment Relations Division at the Montana Department of Labor. Montana also has a separate Workers' Compensation Court, should a claim go to trial. Attorneys Inc. lawyers have represented injured employees before the Workers' Compensation Court on many occasions.

A Workers' Compensation claim is not always the only compensation an employee may receive when involved in a work related injury. Even though non-Workers' Compensation lawsuits are generally not allowed against the employer, in certain situations the employer or another person (a third party) may be liable for work related accidents and injuries. Although these claims are not Workers' Compensation claims, Attorneys Inc. often represents clients on these claims in addition to the Workers' Compensation claim.
